Client Agreement Pack (FINAL, 2026-10-07)

Effective date: 2026-10-07
Last updated: 2026-10-07
Pack version: FINAL 2026-08-18 plus any amendment dated here. Amendment dated 2026-10-07.

This is not legal advice. 10X Performance FZE LLC ("10X", "we", "us", "Mark") is a small, owner-run coaching business. This pack is written in plain English to what we actually do, not to a template built for a larger company. If something in here is unclear, ask before you sign.

This pack is an official document. It's delivered to you by email and accepted by ticking the agreement box on your onboarding form, or by replying to that email. Day-to-day structured questions (intake details, nutrition calibration, check-ins) come to you a different way, through the onboarding forms on our site, and that's a separate channel, not this document.

What this pack is

One document, four jobs, one signature. Signing it means you have read and agreed to the coaching agreement (Section 1), the data storage consent (Section 2), and the health screening and informed consent to train (Section 3). Section 4, results and testimonial permission, is separate: you initial it on its own, and saying no to it does not affect anything else in this pack.

This pack points at, rather than repeats, our full privacy policy and terms of service. Where this pack and those documents cover the same ground, those documents are the fuller statement; this pack is the sign-off.

Section 1: The Coaching Agreement

1.1 What we provide

Individualised strength and endurance programming, delivered through TrainingPeaks or Everfit, with regular check-ins, program adjustments, and periodic review calls. The exact scope, cadence, and price of your coaching are set out in the offer you applied for and confirmed with you directly before you started; this pack does not restate them, because they can change between clients and over time.

1.2 What you commit to

Giving us honest, specific information at intake, especially about injuries, medical history, and training history, since your program is built on it. Logging your sessions in TrainingPeaks so we can coach you off real data. Telling us when something changes: an injury, a missed block of training, a change in circumstances that affects your training.

1.3 Who this is for

You must be 18 or over to sign this pack yourself. If you're under 18, a parent or legal guardian must sign on your behalf and confirms they have the authority to do so.

1.4 Duration and ending coaching

Coaching runs month to month. There's no lock-in, though we recommend thinking of it in three-month blocks, since that's roughly how long it takes to see real adaptation. You can stop at any time. When you do, we'll talk through the mechanics: your last training day, whether your current block finishes or stops early, and whether your current invoice period is paid through.

Notice period for stopping: tell us before invoices go out on the 1st of the month, and the next recurring invoice won't fire. In practice, tell us by the 25th of the month so there's time to process it before invoicing runs. If you tell us after invoicing has already gone out, that invoice stands and coaching runs through the period it covers.

1.5 Payment

We invoice you monthly through Zoho Books, payable by bank transfer. Your card is only ever captured when you pay your first invoice through Zoho's own hosted payment page; we never take or store your card details directly. Once that first payment lands, future invoices can auto-charge the same card instead of waiting on a manual send, if you'd like that set up. If you leave with an invoice outstanding, that's handled separately, through our accounting process, not folded into the exit conversation itself. If you start partway through a month, your first invoice covers the days left in that month, counting your start day, divided by the days in the month, times the monthly price. The full monthly invoice starts on the 1st of the next month.

1.6 Scope: what coaching covers, and what it doesn't

Mark coaches strength and endurance performance and provides nutrition guidance as part of that. He is not a registered dietician or physician. Specific dietary restrictions or clinical health conditions that need specialist management are out of scope, and you'll be referred to a qualified professional for those. This is fitness and performance coaching, not medical advice.

1.7 Communication and working hours

We coach you through TrainingPeaks, WhatsApp, and scheduled review calls. No coaching contact on Saturdays or Sunday mornings. Sunday afternoon is when we finalise your coming week. Weekends outside that are emergency-contact only.

1.8 No result is guaranteed. Coaching improves your chances. It cannot promise a result, a time, a weight or a lift. Your results depend on many things, including how much of the plan you do.

1.9 Waiver. You take part in coaching by choice. To the extent the law allows, you release 10X and Mark from claims for injury or loss that come from your training, except where we were negligent or acted wilfully. Nothing here removes a right the law says you keep.

1.10 Assumption of risk. Strength and endurance training carries a real risk of injury, and in rare cases serious harm. You understand that and choose to train anyway.

1.11 About your coach

ISSA Certified Personal Trainer (current).

  • Literal title, verbatim off the certificate: "CERTIFIED PERSONAL TRAINER."
  • Scope of practice, from the credential's own Code of Ethics (ISSA-CPT Textbook Ch.1, p.19): fitness professionals "shall not misrepresent their education or credential(s) or work outside of their scope of practice," and shall "maintain any and all primary and supplementary certifications (including CPR certification as required)." The specific nutrition boundary, verbatim (Ch.14, p.508): "It is outside the scope of practice for a Certified Personal Trainer to prescribe meal plans to clients. However, they can review a client's eating habits and make suggestions of ways they can improve and eat to support their fitness goals."

ISSA Specialist in Strength and Conditioning (past, expired 2024-12-06).

  • Literal title, verbatim off the certificate: "SPECIALIST IN STRENGTH AND CONDITIONING."
  • Scope of practice, verbatim from the credential's own Fast Track Study Guide (Ethics/Business Practices, "Operate within a legally defined scope of practice," p.80): "Strength and conditioning coach = fitness professional who uses exercise prescription to improve athletic performance, increase injury prevention, support proper movement mechanics." "Nutritional and medical consultations are not within their scope of practice and training qualifications." "Strength coach is not a corrective therapist/physical therapist"

This is fitness and performance coaching, not medical advice.

1.12 Insurance

10X Performance does not hold professional liability insurance today. Coaching is delivered on that basis, and sections 1.9 and 1.10 apply.

Section 2: Data Storage Consent

By signing, you consent to us collecting and storing the data described in our full Privacy Policy, which covers: what we collect (your application and intake answers, training data, a medical and injury screening indicator, nutrition and lifestyle information, your coaching messages, and payment-related information), why we collect it, and how long we keep it.

Where it's held, in short: your training data lives in TrainingPeaks and, for endurance training, syncs from your wearable through Intervals.icu. Coaching messages run through WhatsApp via our business platform (360dialog). Invoices are issued through Zoho Books. Our business email runs on Google Workspace. The full processor list, and what each one does for us, is in Privacy Policy Section 4.

How long we keep it: while you're an active client, for as long as you're coaching with us. After you leave, we currently keep your file indefinitely so you can pick up where you left off if you come back, or ask us to export or delete it at any time. This is our current operating policy, not a fixed legal requirement (see Privacy Policy Section 5 for the full statement).

How to complain. If you are unhappy with how we handle your data, email mark@10xpformance.com first. You can also complain to the data protection authority that covers you.

Your rights: you can ask us at any time to access, correct, export, or delete your data, or to withdraw this consent. Emailing mark@10xpformance.com is how you do any of that. Withdrawing consent doesn't undo anything we did before you withdrew it.

By signing this section, you confirm: you've read the Privacy Policy (or had it explained to you), and you consent to your data being collected, stored, and processed as it describes.

Section 3: Health Screening and Informed Consent to Train

3.0 Health data

Health data. The next questions ask about your health. That is sensitive data. Tick below only if you agree we may collect and use it as Privacy Policy Section 2 describes.

3.1 Screening questions

Do any of the following apply to you?

  1. A diagnosed heart, metabolic, kidney, or other ongoing medical condition.
  2. Prescription medication you're currently taking for an ongoing condition.
  3. A current injury, pain, or physical limitation that could affect your training.
  4. You're pregnant, or trying to become pregnant.
  5. A history of disordered eating or an eating disorder.
  6. Surgery or hospitalisation in the last 12 months.
  7. Any other reason a doctor has told you not to exercise, or that makes you unsure it's safe to start.
  8. Heat intolerance, or a history of struggling with heat during exercise.

3.2 If you flag something

Tick yes to any question above, and we'll talk with you directly about it before your program starts, rather than automatically routing you anywhere. There's no third-party medical-form provider: any flagged answer goes to a direct, one-to-one conversation with Mark, before your program begins, so we can understand what's needed to coach you safely. This matches how our Privacy Policy (Section 2) and Terms of Service (Section 5) already describe this.

3.3 Ongoing disclosure

Your answers here are a starting point, not a one-time form. Tell us if anything changes: a new injury, a new diagnosis, a change in medication, anything that could affect what's safe for you to train.

3.4 Not medical advice

Coaching is not medical advice, and your coach is not a physician. You're responsible for seeking your own medical advice where appropriate, and for getting clearance from a qualified professional before starting or continuing any specific type of training where we ask you to.

By signing this section, you confirm: your answers to the screening questions are accurate, you understand this is not medical advice, and you'll tell us if anything changes.

Section 4: Results and Testimonial Permission (separate, optional)

This section is separate from everything above. You can sign Sections 1 through 3 and leave this one blank, or tick "no permission," and your coaching agreement is complete and valid either way.

What this covers: whether 10X may use your training results, before-and-after data, words, or images in our marketing, and at what level of identification.

Tick one:

  • Named. You're happy for your name to appear alongside your results or a testimonial.
  • First name only.
  • Anonymised. Your results can be used, but nothing that identifies you.
  • No permission. This is the default until you tell us otherwise. None of your results, data, words, or images are used in any marketing, ever.

If you don't tick any box, that's treated the same as "no permission": nothing is used unless you've clearly said yes.

If you say no, we won't ask again. This isn't a maybe we revisit later. A "no permission" here is recorded as permanent, not pending, and it stays that way unless you contact us to change it yourself.

You can change your mind, upward, any time. If your permission level changes (including turning "no" into a yes), email mark@10xpformance.com. We won't proactively re-ask if you declined.

You sign in the Health screen and trial terms form, by typing your full name.
